TracKey Class Action Law Suit

This is the newest article I have read about TracKey. It does not look like Santa will bring it to us for Christmas. The article was “California is why you can’t get the Boss Mustang TracKey” dated 22 September 2012.

Ford has has promoted the TracKey for almost a year, but they may not ever be able to deliver it. I feel that Ford should have courteous to give the Boss owners and Ford dealerships periodic updates about TracKey.

If Ford is unwilling to make an official announcement to the Boss owners by the first of January 2012 all Boss owners should start a class action law suit against Ford for promoting TracKey and not being able to deliver!

Do any other owners feel the same?

I've been tracking my Boss all spring/summer/fall and knocking off Porsche GT3s, M3s, C6 Corvette GSs etc. etc. etc. all for $43k AND WITHOUT TRACKEY. It's far and away the best track car ever produced for the money and possibly one of the most fun to drive on the street. If you want to sue Ford for producing this car and put a damper on their efforts to go even farther with the next Mustang, then go right ahead. Have you even driven your Boss on track yet to know what you're missing (not)? As far as your question, NO.

No. TracKey will be available soon and all of this nonsense will be forgotten.
 
I just hope that they outline exactly what changes when using the Red Key (once this all gets sorted out). Reading about "600+ programming modifications" doesn't intrigue me much since I don't know what the "seat of the pants" affects will be.

In other words, I am not excited about buying something that no one knows anything about really...

Patience, go drive your Boss and don't think about what key is in the ignition. I just wish Ford could do something about my NY winters. Nov 1st Boss is going away for the winter. :(

I feel we are very fortunate to own a Boss! I love my Boss and I do track mine; to put the icing on the cake my salesman also sold a Laguna Seca edition. The guy was not going to track his Laguna Seca so he sold his front splitter, trans and brake cooling to me for $400! I also gave my salesman $100.

I love my Boss and each one of us bought them with the expectation of having TracKey bymid to late summer but I feel we all agree “soon” is no longer an answer.

TracKey was not an option our salesman tried to sell us when we purchased our Boss; it was advertised by Ford before the Boss was on the showroom floors.

It is bait and switch? Perhaps; perhaps not - that is not for us to decide. My issues are with Ford not my Boss. We get nothing but roomers ….next month, next month. Well I am tired of Ford being voiceless about TracKey.

I have called FCS and asked them when TracKey is going to be released. He knew nothing about TracKey on his “list” of answers. He asked me my email address and said he would forwarded my question to someone else answer. The message he forwarded was “Where is my extra key?” nothing about TracKey. Needless to say no one from Ford has answered my questions about TracKey.

Whether you agree with me about a class action law suit Ford is yanking every Boss owner’s chain.

All information I've read indicates Ford is not the problem - CARB is. So a suit against Ford would be misplaced. As far as I know, the folks at the Blue Oval are just as keen on getting this thing out to the owners as we are to get it.

If anything, our ire should be directed at CARB. Only thing is they don't seem to have an email address to contact them to voice our displeasure at their tinkering. You can call them at the number listed on their web site and I guess slow mail them as well. But, apparently they don't want email from anyone from what I can see:

Let me start by saying thank you to Ford for producing such an awesome car. Everyone involved with the program, engineers, technicians, managers - THANK YOU, you did a great job. A car I have dreamed they would produce.

A car good enough and respecting of the heritage of the original Boss 302, that I called dealers, got on lists, eventually plunked down my money, ordered and waited for my car to be built and delivered. And I am very happy to have one!

As far as Trackey sure I would like it to be here, as I am sure the enthusiasts at Ford that developed it want us to have it. I am quite sure they would like nothing more than it to be released and on all our cars. They are not the ones holding it up. And I think eventually we will have Trackey and this will be old news.

So if you are law suit happy and have the resources, have a lawyer challange carb and figure out how an agency of unelected bureaucrats (appointed by the govenor) have so much regulatory power over the automobile and aftermarket industries. Figure out if your state is adopting carb regs. Elect people that are going to roll back state and federal regulations - they are costing us lots of money and fun factor. Sorry to bring politics into this, but elections have concequences and you are seeing some in action.

It's easy to rag on Ford on this one, but they have to deal with the bureaucratic regulatory nightmare, that apparently we have allowed to amass so much power.

I'll give you that one. It will be very interesting to (hopefully) find out when all this is past history just why CARB had such a stick up their butt on this issue: a limited production car, a great but not exclusive tune. Hardly seems a significant environmental impact problem. Plus, I'd find it hard to believe there aren't tons of Mustangs in the Golden State that have aftermarket tunes. I'd imagine officially CA would say they are not allowed, but unless the mod doesn't pass state inspections who's to know?

Maybe so, but then we wouldn't know anything about it and I prefer to know what they are doing and what is coming.

When you get right down to it, this only affects a small portion of Boss owners that will be able to actually use it as planned (track). For the rest of us it will be a fun novelty to run the car with.

Most class action lawsuits are about the lawyers getting $$$$ and the consumer getting .01c. This country would be a lot better off if we had less lawyers (especially in public office) ;). No reason to sue just go drive the s*** out of your Boss knowing that you and 99% of the owners will not be able to drive it to it's full capabilities even without Track Key. ::)

If Ford really wanted to appease us BOSS owners for this extraordinarily long wait for TRACKEY, they would waive the $302.00 install fee (either outright or with a rebate) once TRACKEY ever does get approved..of which I starting to have my doubts.

that would make a great xmas gift for us boss owners who have been good all year :)

Great idea for everyone else but I had it thrown in as part of my purchase.
 
Ford couldn't even start the approval process with CARB until they had the first production vehicle made. So it is by no means Ford's fault that everything is taking so long. Although I agree that Ford has done a piss poor job of keeping their customers informed of what is or isn't going on with the Trackey...that part you will get no argument from me.
